Rare handwritten circular in four sheets from the Minister of Justice Jean-Jacques-Régis de Cambacérès reminding to the Criminal and Correctional Courts the execution of the law of 10 Brumaire of Year V of the Republic prohibiting the import and sale of English goods.


In the upper left margin:

Handwritten note "Litigation to be registered"

We are invited to recall in the margin of the answer, the name of the Office and the number above


Header with allegory of the Republic, the latter represented seated and wearing a Phrygian cap, inscribing with her right hand the table of LAWS, in front of her a bundle of lictor, a rooster represented behind her. The words Freedom – Equality on each side.

"To the Administrators of National Customs (Customs Litigation)
To satisfy, Citizens, the request you made to me in your letter of 17 Vendémiaire last (October 09), I warn you that I am writing circularly to all the Commissioners of the Executive Directory near the Correctional and Criminal Courts of the Border and Maritime Departments in order to remind them of the provisions of the circular before my predecessors dated 10 Prairial year 5 (May 30, 1797) on the law of 10 Brumaire (November 1st, 1795) and that of Ventose 26 (March 16, 1796) of the year 4. I am sending you a copy of my circular.

The Minister of Justice to the Commissioners of the Executive Power to the Criminal and Correctional Courts of the Border and Maritime Departments of the Republic.

The endorsement of my predecessors Citizens, by his circular of 10 Prairial of the year 5, recommended to you the strict execution of the laws of 10 Brumaire of the year 5 on the prohibition of English goods and on the importation of grain ; it also recommended that you respectively appeal to the Criminal Court or exercise your appeal in Cassation whenever a Correctional or Criminal Court did not strictly comply with the provisions of the laws. I have no doubt that each of you has complied with what has been prescribed for you; however, the National Customs Administrators having observed to me that the Court of Cassation rejected the appeal issued by their agents, when they were not personally condemned, I believe I should remind you of my predecessor's circular so that you act -even in the event of violation of the forms and that none of you can to excuse his silence, to allege that the customs could call or appeal in Cassation; Please acknowledge receipt of my letter and remind you that I urge the Customs Administrators to notify me of any wrongful judgments against which, however, there would have been no appeal or recourse to Cassation.
